Sectional Title Airbnb Rules: Navigating Compliance in Cape Town

• Sectional Titles Act 95 of 1986
• Sectional Titles Schemes Management Act 8 of 2011

These laws empower sectional title schemes to amend conduct rules through special resolutions aimed at managing or restricting short-term letting. However, implementation can be complex given many owners depend on Airbnb income.

Booking Duration and Local Bylaws

Cape Town's local bylaws specify a maximum booking duration of 30 days per rental, defining the legal boundary for short-term rentals within sectional titles. This regulation aims to balance the benefits of tourism with maintaining residential community stability.

Upcoming Regulatory Changes Impacting Sectional Title Short-Term Rentals

Recent policy developments by the Department of Tourism aim to tighten short-term rental regulations citywide by requiring hosts to:

• Register with official tourism boards
• Pay hospitality or lodging taxes
• Adhere to health and safety standards similar to hotels and guesthouses

These changes may increasingly encourage conversions from Airbnb listings to long-term rentals, especially in sectional title schemes where short-term rental disruptions have caused trustee concerns.

Benefits of Complying with Sectional Title Airbnb Rules

• Community Harmony: Reduces disputes with neighbors and trustees
• Security: Minimizes risks associated with high tenant turnover
• Investment Stability: Protects property values by maintaining building standards
• Legal Safety: Avoids costly fines, penalties, or litigation
